CareerKernel Terms of Service

Version 1.0. Effective [DATE].

These terms cover careerkernel.io, the beta programme, and buying a licence. The desktop application itself is covered by the End User Licence Agreement, and how we handle information is in the Privacy notice. Where these terms and the EULA disagree about the software, the EULA wins.

"We" and "us" means [LEGAL ENTITY NAME]. "You" means you.

1. Who may use this

You must be at least 18, or the age of majority where you live, or have a parent or guardian agree to these terms for you.

CareerKernel is built for people looking for work, including students and recent graduates. It is not for recruiters, staffing agencies, or anyone operating a service on behalf of other job seekers.

2. The website and the beta list

If you give us your email address to join the beta list, we use it to tell you about the beta and about CareerKernel. We do not sell it, rent it, or pass it to anyone else. You can ask us to delete it at any time by emailing [email protected], and we will.

What the signup form stores is set out in the Privacy notice.

You may not attempt to break into, overload, scrape at scale, or interfere with the website or its endpoints, or probe them for vulnerabilities without asking us first. If you find a security problem, we would genuinely like to know: email [email protected] and we will not pursue you for reporting it in good faith.

3. The beta programme

While CareerKernel is in beta:

without notice;

your own computer, so you can copy it yourself;

anything for it and without having to keep it confidential. Do not send us anything you want to keep or be paid for. This does not give us any right to your resume, your job search, or anything else personal, and the application does not send us those things at all.

We may end the beta programme, or your participation in it, at any time.

4. The free trial

CareerKernel is free to use for 7 days, once per computer. Section 5 of the EULA explains how that is enforced and what the application sends us.

No payment details are needed for the trial. It does not turn into a paid subscription on its own.

5. Buying a licence

Price. [PRICE AND BILLING TERMS. If it is a subscription, say the amount, the period, that it renews automatically, how to cancel, and how much notice is needed.]

Payment. Payments are handled by Stripe. We never see or store your card details. Stripe's own terms apply to the payment itself.

What you get. A licence key, sent to the email address you bought it with. The key is checked on your own machine, so it does not stop working because this company stopped existing.

Delivery. Keys are issued automatically after payment. If one does not arrive, email [email protected] and we will send it.

Refunds. [REFUND POLICY. A plain 14 or 30 day no-questions refund is the simplest thing to administer and the easiest to defend. Note that consumer law in many places gives buyers a cancellation right you cannot sign away, so a lawyer should set this.]

Tax. Prices [include / exclude] any applicable sales tax or VAT.

6. What CareerKernel does, and what it does not promise

CareerKernel reads job listings from employers' own public career pages and applicant tracking systems, and helps you prepare applications to them. It runs on your computer.

Please read these, because they are the limits of what the product can do.

constantly, and a job board can change shape overnight and stop being readable. A listing shown as open may have closed; an employer absent from the catalogue may be hiring.

USCIS H-1B records and makes rule-based guesses from the wording of job postings about seniority and sponsorship. Those guesses are frequently wrong in both directions. Do not decide anything about your visa, your immigration status, or your eligibility to work based on what this product says. Ask a qualified immigration lawyer.

past does not mean it will sponsor you; that it has no record does not mean it will not.

them open. It never presses submit, never types a password, never creates an account and never solves a CAPTCHA. Check every application before you send it. Everything you send is your statement, not ours.

relationship with any employer or job board.

7. Acceptable use

You may not use CareerKernel or this website to:

or collects, as described in section 3.6 of the EULA;

8. Intellectual property

CareerKernel, its name, its logo, the website and all the content on it belong to us. Section 4 of the EULA covers the software and the data that ships with it.

Job listings themselves belong to the employers who published them.

9. Disclaimers and liability

The website and the service are provided "as is" and "as available", without warranty of any kind. We do not promise the website will be uninterrupted or error free.

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive loss, or for lost profits, lost opportunities, lost job offers, lost data or reputational harm.

Our total liability to you for everything arising out of or relating to the website or the service is limited to the greater of what you paid us in the twelve months before the claim, or [AMOUNT, e.g. USD 50].

Nothing here limits liability that cannot lawfully be limited, or affects a statutory consumer right you cannot waive.

10. Ending it

You can stop using CareerKernel at any time, and ask us to delete your email address.

We may suspend or end your access if you breach these terms or the EULA. If we end a paid licence for a reason other than your breach, we will refund the unused part of what you paid.

11. Changes to these terms

We may change these terms. If a change is significant, we will say so on the website and email anyone on the beta list. Continuing to use the website or the service after a change means you accept it.

The version in force when you bought a licence is the one that governs that purchase.

12. General

Governing law. These terms are governed by the laws of [STATE/COUNTRY], without regard to its conflict of laws rules. The courts of [JURISDICTION] have exclusive jurisdiction, except that either of us may seek an injunction anywhere to protect intellectual property.

Severability. If part of these terms is unenforceable, the rest stays in force.

No waiver. If we do not enforce something straight away, we have not given up the right to.

Assignment. You may not transfer your rights under these terms. We may transfer ours as part of a sale or reorganisation of the business.
